We ask that you read these policies in detail. Call us if you have any question regarding these
policies before you book your cruise by calling 828 389 CALL (2255) If you disagree with our
food policies and cautions or do not wish to be bound by them do not book a cruise, or Magical
Mountain motor Tour, or lodging with a food or drink component or package, as booking a
cruise etc. is your acceptance and consent that you agree to accept, be bound by and follow the
policies and cautions listed on this page without exception.
Federal and state warning:
Warning: We are required by Federal and State law to advise you that eating raw or undercooked seafood, eggs, meat or
poultry can result in serious illness or death. You can also become seriously ill or die from other food products or
ingredients or fruits and vegetables. In fact any thing you ingest that is spoiled or containing high bacteria or germ
content etc. Will cause you harm so Please read our food policies carefully.
Food Safety:
Many factors affect the safety of food whether cooked or uncooked. Time, Temperature, Exposure, Type of Products and
how the products were handled, stored and served are just a few of the considerations that are the basis for this policy.
Food Safety requires that food not consumed within a safe period usually one or two hours depending on the type of food
must be refrigerated or disposed of to protect your health. We dispose of all food and beverages that fall under this policy
appropriately in keeping with this policy. Also as part of this policy:
1. You are not permitted to bring any food or drink into any site or location or on to any vessel or vehicle except lodging.
2. You are not permitted to bring any food or drink from a restaurant, even if that restaurant is one of our vendors or
from any other source for storage or consumption aboard a vessel or vehicle.
Our Captains and our Drivers are not permitted to allow outside food or drink to be stored or transported. This policy is
for your protection and there are no exceptions so please consume or dispose of food or beverages in your possession
before commencing or continuing services with us. This includes all food, snacks, gum, candy and any other consumable
whether packaged or not and any beverage other than water meaning no sports drinks etc.
Taking Food With You:
1. We discourage the taking of left over food with you, particularly foods with sauces, mayonnaise, cakes etc. and especially
in warm weather. We will not prohibit you from taking such food and we will wrap it in tin foil if available if you insist
on taking such food or non alcoholic beverages with you. Tin foil offers no protection from spoilage and you are
removing any and all food and non alcoholic beverages over our warnings and at 100% of your own risk.
Food safety information as contained herein and as may be given to you by a Captain, Driver or other employee, agent or
other on our behalf (We have no obligation to do so) is for your benefit and should not be ignored to protect your health.
2.You agree that you are:
100% responsible for your decision and by removing any food or non alcoholic beverage, alcoholic beverages may not be
removed from our premises or conveyances by Law in bot Ga. and NC. You agree that you accept 100%of all risk
associated with and all consequences of said removal and further that you fully release and indemnify and hold harmless
Fitness Service Corporation, Romantic Lake Cruises, Magical Mountain Motor Tours, Simple Pleasures, the Chatoogie
Queen, Teddy Bear Cottage and any and all owners, officers, employees, agents, stockholders and others acting on our
behalf to include the costs of representation and appearance and you shall be liable and agree to pay any and all money
damages and judgments if any which may be incurred as a result of the action or inaction of any party to any proceeding as
a result of your action or inaction regarding this policy. Please dispose of all uneaten food and beverages for your own
safety and health.
3.Under no circumstance will you be permitted to take any open or unopened bottle of wine with you. There are strict
laws in the States of Georgia and North Carolina concerning such beverages and we comply with all Federal and State laws
as to open containers and transportation of alcoholic beverages. Wine is an alcoholic beverage. You are not charged for
wine. It isprovided to you as a complimentary beverage and at no time does it belong to you to avoid the problems
associated with the consumption, removal and/or transportation of an alcoholic beverage.
Food Preparation Policy:
All food prepared for consumption is fully cooked with no exceptions. We do not under cook any product and do
not honor requests to under cook any product when ordered by you without a written harmful food release by you.
Food Allergies:
Food Allergies can cause serious illnesses or death. If you have food allergies be advised that our vendors do not take
extra precautions in the preparation of foods or beverages. The food and beverages are wholesome and edible in keeping
with appropriate health laws. It is your responsibility to determine what you are allergic to and whether or not to order or
eat any food, snack or beverage. Peanuts and /or other allergen producing foods and materials such as wheat, whey, soy
andmany other allergen producing products and ingredients are used in some dishes and in areas and with utensils that
may have come in contact with allergen producing products so please act accordingly.
